Description of Incident:

A Miami Beach man remains in jail accused of forcing a young boy to engage in sex acts in a public restroom at the Swap Shop on Saturday.

Shortly after 4 p.m. the 10-year-old victim went to a restroom in the main building at the Swap Shop at 3291 West Sunrise Boulevard in unincorporated Central Broward. The boy noticed an adult male masturbating at one of the urinals. As the victim was coming out of the stall, the suspect, Benjamin Elisha, grabbed him by the arm and forced him back inside.

In a matter of minutes, Elisha forced the young boy to perform a sex act on him. After which, Elisha started performing a sex act on the boy. The boy punched the suspect in the head in order to escape. Immediately, the boy told his grandfather what had just occurred. His grandfather and other patrons detained Elisha until Swap Shop security officers arrived and Broward Sheriff's Office deputies took the suspect into custody. The victim was transported to the Sexual Assault Treatment Center where he was examined and evidence was collected.

During questioning, Elisha told BSO sex crimes detectives he did masturbate in the restroom, but he denied all sex allegations involving the boy. Elisha remains in jail without bond. He faces two counts of Sexual Battery on a Child Under 12, one count of False Imprisonment on a Child while Committing Sexual Battery, and one count of Lewd or Lascivious Exhibition.
